Vivre has created this privacy statement in order to demonstrate our firm commitment to protecting your privacy. We will not sell, rent, or distribute your name, e-mail address or other identifiable information to any third party without your consent. Please check back periodically as our privacy policy may change from time to time.

Information Collection and Use

To provide you the best possible products and services, we will request specific personal information when you register on vivre.com, when you make a product or gift card purchase, and when you request a catalogue. Any personal information collected on vivre is knowingly and voluntarily provided by customers and visitors to our site.

At registration, we collect your name, shipping and billing addresses, telephone numbers, and e-mail address in order to deliver your orders promptly and to the proper location. We use your e-mail address to send you two emails following a purchase. The first confirms that your order was shipped, and provides an itemized order summary with your order number. The second e-mail provides you with a FedEx tracking number so that you can determine the status of your order. Please note that should any of your items be on-reserve, out-of-stock or discontinued, you will receive an additional email after your order confirmation specifying the specific status of each item in question. If necessary, a Customer Care Associate may contact you by telephone to resolve any issues concerning your order.

When you make a gift card or product purchase, we collect your credit card number and your expiration date. We have security measures in place to protect the loss, misuse and alteration of the information under our control. We will automatically store your credit card number and expiration date on our secure server with your account so that you will not have to fill out this information again during future visits and purchases at vivre.com. This information is used solely for billing purposes when you order from vivre.com and is always encrypted and transmitted safely over the Internet using Secure Sockets Layer (SSL) technology. When you request a catalogue, we collect only contact information, name and address.

We may occasionally run contests and other similar promotions on our site in which we ask visitors for contact information (such as their e-mail address) and demographic information (such as their zip code, age, or income level). We use this contact information to send registered users and current customers and catalogue requesters information about our company as well as marketing and promotional materials from our company as well as our partners.

We use your IP address to help diagnose problems with our server and to administer our Web site. Your IP address is also used to help identify you and your shopping cart. Your name and password are used to verify that you are a registered customer and prevent anyone else who may have access to your computer from ordering in your name without your express permission.

Any email that you may sent to us or any correspondences are strictly confidential and are not distributed to any partner or third party.

Any information you provide will be used to:

Co-branded Relationships

vivre.com has developed strategic partnerships in which users may experience vivre.com within a co-branded environment alongside one of our partners. In such situations, individual user information may be shared only between our two companies in an effort to better understand and meet our customers' needs. Will I be charged sales tax?

Domestic taxes, USA- Sales tax is applicable on orders shipped to addresses in the states of New York, Ohio. The amount of sales tax may vary by county within this state. New York laws require that we charge a sales tax on the full amount of the order. Because charges for gift-wrap and shipping and handling are considered part of the product, by law these charges must be included when sales tax is calculated.

International- All duties and taxes are the recipient's obligation. The recipient will be required to pay the duty or VAT upon delivery. Due to import duty valuation adjustments and currency valuations, we are unable to provide an estimate for duty or VAT. How can I give someone a gift using Vivre?

Sending a gift from Vivre is a wonderful way to show someone special your appreciation. We've made it easy by offering you two options when picking out that perfect present.

If you'd like to send the gift directly from Vivre

On each of the product page and shopping bag, you will be asked whether you would like to use our signature gift packaging. Should you choose this option, a gift invoice, absent prices, will be included with your package.

You may also include a personalized note, hand-written, to your order. At step 2 of the checkout process, you will be asked whether you would like to send a personalized message for specific products in your order. You may also request blank cards so you can hand-written your message directly.

Use our multiple ship-to capability to send gifts to different addresses, whether you're sending the same gift to everybody or different gifts to each address, vivre.com gives this option is the second step of the checkout.. Look for it at the Shipping and Gifting options in step 2 of the checkout.

If you'd like to send the gift on your own:

When you receive your purchase, we've included an invoice for your records. On the reverse side there is a detachable gift receipt to be presented with your item.

    International Shipping: Timing and Duties

    Since international shipments are subject to verification, paperwork and certain credit card security checks, please allow up to 10 business days for your item to ship. All duties and taxes are the recipient's obligation. The recipient will be required to pay the duty or VAT upon delivery. Due to import duty valuation adjustments and currency valuations, we are unable to provide an estimate for duty or VAT.     Vivre uses FedEx International Priority for all its international shipments. From the date of shipment, FedEx delivery typically takes 2 to 4 business days and reaches major cities in Europe by 10:30 a.m.

    We will request signature at delivery. Please be sure a person is able to receive the package at your delivery address.

    International Shipping: Refused shipments

    If for any reason you refuse delivery or do not respond to a delivery notice, your credit card may be charged for the full amount of the transaction. Please review carefully duties and taxes prior to the shipment of your package.

    International Shipping: Other Disclaimers Because international orders are subject to special security checks and export regulations, we reserve the right to cancel any international order. We will contact the customer who placed the order to notify them of the cancellation, providing a viable contact e-mail address has been given to Vivre.

    Cancellation reasons may include:
    (a) Payment cannot be cleared through the card details provided and requests for further information are not answered within a reasonable time frame
    (b) Insufficient delivery address details are provided and we have received no reply to our request for further information

    Vivre proudly stands behind the quality brand names we offer our customers. If for any reason you are dissatisfied with an item, we will gladly accept it provided we receive it within 30 calendar days of item shipment date and refund you for the original purchase price, minus the shipping, handling, gift wrapping or other charges according to our Return/Exchange Instructions. Reference: How to Make a Return if you have questions. Please let us know the reason for your return/exchange so we can serve you better in the future. This 30-day Guarantee only applies to full price items.

    Important: Vivre will not accept returns received outside of the conditions stated above. In the event of an exception to this policy, customer will be credited with a 'store credit' and a re-stocking fee up to 50% of the item value may apply.

    Error in Shipping

    In the unlikely event that we processed your order incorrectly or shipped you a defective item, we will gladly take back that item and credit you the purchase price, sales tax and original shipping and wrapping costs - and take whatever corrective action suggested on your return form (this form can be found on the back of the packing slip included in your package). Please contact us within 48-hours of items received.

    Final Sale Merchandise

    No returns will be accepted on Final Sale Merchandise. Final Sale Merchandise are identified on the product page of the website or by the Customer Service Representative when you place an order. It is also identified in the confirmation email and the packing slip. We will allow you to exchange a Final Sale Item for another size, depending on availability. Please contact Customer Service to inquire about Sale Merchandise Exchanges.

    Special Orders, Special Items and Personalized items

    Special orders, special items or personalized items cannot be returned or exchanged. Special items are identified on the product page of the website or by the Customer Service Representative when you place an order. It is also identified in the confirmation email and the packing slip. These items are final sale only.

    How can I return an item?

    If for any reason you're not satisfied with your full price selection, please return the unused item in its original packaging within 30 days for an exchange, a full refund (less shipping and handling charges), or credit.

    For your convenience, we include a pre-paid FEDEX PRP return label with every order. If you choose to return your purchase, please call 1-800-GO-FEDEX to schedule a free pick up. If you choose this return method, a processing fee of $10 will be deducted form your refund or credit.

    Items on sale, special orders or personalized items cannot be returned.

    Please note: Once your item is delivered, you have 30 days to return it for a full refund (less shipping, handling, gift wrapping). Vivre will not accept any returns after 30 days.

    What is your return policy on sale items?

    No returns will be accepted on Final Sale Merchandise. Final Sale Merchandise are identified on the product page of the website or by the Customer Service Representative when you place an order.     How do I use my gift card online?

    If you received your gift card after February 9, 2006

    After you have made your selection and are ready to finalize your purchase, proceed to the checkout. Enter your gift card information in step 3 of the checkout, as if you were using another credit card. Enter the claim code number from the upper right hand corner of your card exactly as it appears on your gift certificate or gift card into this field, and click on redeem. Your credit will then appear in the total above.

    If you received your gift card or gift certificate before February 9, 2006

    Please contact our customer care to redeem your gift card. With the launch of the new VIVRE.COM and for security purposes, we will redeem your gift card through the phone. To check your gift card balance, please contact our customer care department at 800-411-6515.

    How do I use a promotion code?

    After you have made your selection and are ready to finalize your purchase, proceed to the checkout. At the Shopping Bag page, scroll down and you will see your total along with a field labeled Enter Promotional Code. Enter the claim code number from the upper right hand corner of your card exactly as it appears on your VIP card or promotion into this field, and click on submit. Your discount will then appear in the total above.

    Why is my item on backorder?

    As a global luxury retailer, we carry a wide variety of products from all over the world. There are a number of reasons that your particular product may be on backorder including variable delivery times from international vendors, and high sell through on very popular items. When a well liked product becomes sold out, we often attempt to reorder the piece, and your item may be on backorder until we receive our next shipment.
